THE SUBJECTIVE COMPOSITION OF THE INTEGRATED STATE BORDER MANAGEMENT OF UKRAINE AND WAYS TO IMPROVE IT IN THE LIGHT OF THE EXPERIENCE OF FORMATION OF THE INTEGRATED BORDER MANAGEMENT OF THE EUROPEAN UNION

Abstract

The article examines the issue of the subjective composition of the integrated management of the state border of Ukraine and the ways of its improvement with due regard to the experience of the European Union's integrated border management.It is stated that the development of integrated state border management of Ukraine (hereinafter referred to as – ISBM of Ukraine) is of particular importance given the critical functions inherent in the state border in the context of ensuring the national security of Ukraine. Ukraine is gradually implementing integrated border management tools based on the experience of the EU integrated border management, as evidenced by the amendments to the Law of Ukraine “On National Security of Ukraine”, which include the strategic framework for integrated management of the state border of Ukraine.The subjects of the ISBM of Ukraine are the National Guard of Ukraine and the Armed Forces of Ukraine, the Ministry of Internal Affairs, the Ministry of Foreign Affairs, the Ministry of Infrastructure, the Ministry of Finance, the State Migration Service of Ukraine, the State Customs Service, the State Service of Ukraine for Food Safety and Consumer Protection and law enforcement agencies, the State Border Guard Service, and the Security Service of Ukraine. The powers of the actors in this area are determined mainly by the legal acts establishing the legal status of these bodies, and their tasks for a certain period are specified in the Strategic and Planning Documents in the field of the ISBM of Ukraine. The subjective composition of Ukraine’s integrated state border management includes several military formations, key ministries, other central executive authorities, and law enforcement agencies whose state interests cover the functioning of the state border of Ukraine.It is believed that promising areas for improving the legal regulation of the ISBM of Ukraine may include: 1) defining the powers of the relevant public authorities to implement the policy in the field of ISBM of Ukraine in the legal acts regulating the organizational and legal framework of their activities; 2) establishing a coordination center as an advisory body under the Administration of the State Border Guard Service; 3) strengthening practical cooperation in the field of combating cross-border offenses of the ISBM subjects of Ukraine with FRONTEX and national subjects of integrated border management of the EU Member States.
