ІNVESTIGATIVE REVIEW DURING THE INVESTIGATION OF MASS UNRESTS

Abstract

The article is devoted to the study of the concept, meaning and types of investigative inspection. It is established that during the investigation of mass riots, the investigative inspection is one of the leading investigative (search) actions, which is carried out at the initial stage of the investigation and allows you to record information discovered by the investigator during the inspection, which is the main source information for confirming the event of a criminal offense, determining the direction of the investigation and the list of investigative (search) actions required to be carried out in criminal proceedings, as well as the formation of investigative versions. The investigative inspection provides for such types of inspection as an inspection of the scene of the incident (locality, land plots, premises, apartments, etc.), an inspection of a corpse, a vehicle, things and documents, as well as computer data. The features, tasks and tactics of the inspection of the scene of the incident during the investigation of mass riots are studied. Attention is focused on the fact that the inspection of the scene of the incident in criminal proceedings on the investigation of mass riots is characterized by the need to simultaneously resolve organizational, procedural and tactical issues. It has been determined that most traces of mass riots can be destroyed during uncontrolled crowd actions or lost due to the impossibility of timely conducting investigative (search) actions, and therefore conducting an investigative inspection requires quick decision-making, coordinated and organized work of employees of investigative and operational units. Tactical and organizational principles of inspecting the scene of an incident during the investigation of mass riots are due to the fact that the crimes under investigation are characterized by their scale and coverage of large areas of the area with a concentration of various objects and a significant number of traces. As a rule, mass riots are committed on central squares, avenues or streets, near stadiums, buildings of state authorities or law enforcement agencies and in open areas of the area. Tactically important is compliance with the sequence of conducting the inspection, determining its boundaries and objects, as well as choosing the inspection method.
