DOMESTIC VIOLENCE AS A VIOLATION OF HUMAN RIGHTS AND A SOCIAL PROBLEM

Abstract

The article provides a comprehensive analysis of domestic violence as a serious violation of human rights and a profound social problem. Particular attention is paid to the fact that domestic violence is not only a private matter for individual families, but also a violation of fundamental rights and freedoms guaranteed by the Constitution of Ukraine and international law. The study examines how alcoholism significantly affects the dynamics of violent behavior, reducing self-control, provoking aggression, and creating danger in conditions of emotional intimacy within the family. The authors highlight four main forms of domestic violence in accordance with current Ukrainian legislation: physical, sexual, psychological, and economic. The article describes in detail each type of violence, its manifestations, and consequences for victims. It also raises the issue of stereotypes that prevent society from adequately perceiving the problem of domestic violence, in particular regarding who can be a victim. An important part of the article is devoted to the analysis of legal mechanisms for the protection of persons experiencing domestic violence. It examines the concept of an emergency restraining order issued by the police and a restrictive order issued by the court. It notes that these instruments are important preventive measures that allow for a rapid response to cases of violence and protect victims. In conclusion, the authors emphasize that domestic violence can only be overcome with active legal, psychological, and social support for victims, effective enforcement of legislation, and the formation of a culture of zero tolerance for all forms of violence in the family.
