TACTICS OF CRIME SCENE EXAMINATION DURING THE INVESTIGATION OF CRIMINAL OFFENSES RELATED TO DOMESTIC VIOLENCE UNDER MARTIAL LAW

Abstract

The article examines key aspects of the tactics of conducting a scene inspection during investigations of criminal offenses related to domestic violence, which are of particular relevance in martial law. It is noted that conducting this investigative (search) action in criminal proceedings related to domestic violence under martial law is accompanied by a number of serious challenges that affect the quality and completeness of evidence collection. The content of the preparatory, working and final stages of the scene inspection is considered, as well as their tactical tasks and organizational features are determined. Particular attention is paid to the issue of ensuring the safety of participants in the investigative (detective) action, the interaction of the investigator with specialists of various profiles, the use of modern technical and forensic tools, including unmanned aerial vehicles. The specifics of the detection, fixation and removal of material, biological and digital traces are also considered. The importance of a comprehensive approach to assessing the scene of the incident is emphasized, taking into account possible signs of concealment of domestic violence, the psychological state of the victim and the features of the trace picture. It is concluded that the effectiveness of the scene inspection in criminal proceedings on domestic violence and related criminal offenses during martial law depends on the correct organization of the investigative (search) action, the timely use of forensic recommendations, modern technical means and interagency cooperation. It is important to take into account security factors that ensure complete, comprehensive and objective collection of evidence and increase the effectiveness of the pre-trial investigation. The emphasis is on the mandatory provision of completeness and accuracy of the depiction of the scene of the incident, since it is these data that have evidentiary value in criminal proceedings.
